These Terms of Service ("Terms") govern your use of the Run Motivators websites, your purchase of products or event registrations, and your participation in virtual races, walks, challenges, and other activities offered by Run Motivators LLC, including activities offered under the Run Motivators and Run Like a Woman names (collectively, "Run Motivators," "we," "us," or "our").

By accessing this website, creating an account, registering for an event or challenge, or completing a purchase, you acknowledge that you have read, understand, and agree to these Terms and any policies incorporated into them.

If you do not agree to these Terms, you should not complete a purchase, register for an event, or participate in a Run Motivators activity.

1. Online Store & Purchases

Run Motivators offers virtual event registrations, challenge rewards, medals, apparel, accessories, and other merchandise through this website.

By placing an order, you represent that:

• The information you provide is accurate and complete.

• You are authorized to use the payment method provided.

• You have reviewed the applicable product description, pricing, estimated shipping information, and policies before purchasing.

• You are at least 18 years old.

• Your purchase is subject to these Terms and our Refund, Return, Cancellation & Shipping Policy.

We reserve the right to refuse or cancel an order when reasonably necessary, including in cases of suspected fraud, payment problems, pricing or listing errors, inventory errors, abuse of promotions, or circumstances that prevent us from fulfilling the order.

If Run Motivators cancels an order after payment has been collected, the applicable amount paid for the canceled item or order will be refunded.

2. Pricing, Product Information & Errors

We make reasonable efforts to accurately display product descriptions, photographs, availability, pricing, shipping information, and other information on our website.

Occasionally, information may contain typographical errors, inaccuracies, omissions, incorrect pricing, or inventory errors. We reserve the right to correct errors or update information and, when necessary, cancel an affected order.

Product photographs, artwork, and digital mockups are intended to provide a reasonable representation of the finished product. Colors, finishes, dimensions, placement, materials, and other details may vary slightly from photographs, digital renderings, prototypes, or samples due to manufacturing processes and differences in electronic displays.

3. Preorders & Estimated Shipping Dates

Some Run Motivators products, including event and challenge rewards, may be offered for preorder before they are manufactured or available for shipment.

By purchasing a preorder item, you acknowledge that the product is not immediately available for shipment.

Production, arrival, and shipping dates displayed on product pages or provided in communications are estimates and are not guaranteed. Manufacturing delays, freight delays, customs processing, weather, carrier delays, and other circumstances outside our control may affect these estimates.

Preorders may be canceled upon written request at any time before the order has been processed for shipment, subject to the processing/restocking fee stated in our Refund, Return, Cancellation & Shipping Policy.

Once a preorder has been processed for shipment, it can no longer be canceled.

A change or delay in an estimated production, arrival, or shipping date does not otherwise alter the cancellation policy applicable to the order.

If an order contains both in-stock and preorder merchandise, items may ship together or separately depending on product availability and fulfillment requirements.

4. Refunds, Returns, Cancellations & Shipping

All purchases are subject to the Run Motivators Refund, Return, Cancellation & Shipping Policy, which is incorporated into these Terms by reference.

That policy contains important information regarding order cancellations, preorders, returns and exchanges, final-sale merchandise, processing and restocking fees, damaged or incorrect merchandise, shipping and delivery, packages marked delivered, lost or significantly delayed packages, incorrect shipping addresses, international shipments, and refund processing.

By completing a purchase, you acknowledge and agree to the Refund, Return, Cancellation & Shipping Policy in effect at the time of purchase.

5. Virtual Events & Challenges

Run Motivators races, walks, fitness challenges, mileage challenges, step challenges, and similar programs are virtual activities.

Unless specifically stated otherwise, Run Motivators does not organize, supervise, control, inspect, approve, or select the location where you participate.

You are responsible for determining when, where, and how you complete an activity and for selecting locations, routes, conditions, distances, and activities appropriate for your abilities and circumstances.

Distances, mileage, steps, repetitions, or other activity goals may generally be completed according to the instructions provided for the applicable event or challenge.

Participation and results reporting are based on the honor system unless otherwise stated. Participants are responsible for accurately reporting their own activity and results.

Run Motivators does not guarantee that participation in an event or challenge will result in weight loss, improved fitness, improved health, completion of a particular distance, or any other specific result.

Failure to begin, participate in, or complete an event or challenge does not entitle a participant to a refund.

6. Assumption of Risk

You recognize and acknowledge that physical activity involves inherent and other risks of injury.

Walking, running, hiking, exercising, and other recreational or fitness activities may involve risks including, but not limited to, falls, collisions, traffic, road or trail conditions, uneven terrain, weather, heat, cold, encounters with animals or other people, equipment failure, overexertion, dehydration, illness, physical injury, disability, incapacity, or death.

By choosing to participate in a Run Motivators event or challenge, you voluntarily and knowingly assume the risks associated with your participation.

You are solely responsible for determining whether you are physically capable of participating and whether a particular activity, distance, location, environment, or level of exertion is appropriate for you.

Run Motivators does not provide medical advice. You are responsible for obtaining appropriate medical advice before beginning or participating in physical activity when appropriate for your individual circumstances.

7. Waiver & Release of Liability

To the fullest extent permitted by applicable law, by participating in a Run Motivators virtual event or challenge, you voluntarily assume the risks associated with your participation and release Run Motivators LLC and its owners, officers, employees, agents, representatives, contractors, volunteers, sponsors, and affiliates (collectively, the "Released Parties") from claims arising from injuries, illness, damages, losses, incapacity, or death resulting from or associated with your voluntary participation in the activity, except to the extent that liability cannot lawfully be waived.

This release includes claims associated with your selection of a participation location or route; the conditions at that location; your chosen activity or equipment; weather, traffic, terrain, animals, other people, or environmental conditions; transportation associated with your participation; and other circumstances connected with your participation.

You understand that Run Motivators does not supervise your participation or inspect or control the locations where virtual activities are completed.

You acknowledge that you have read and understand this assumption of risk and waiver and voluntarily agree to it as a condition of participating in a Run Motivators event or challenge.

Nothing in these Terms is intended to waive or limit any right or liability that cannot legally be waived or limited under applicable law.

8. Age Requirement

Run Motivators virtual events and challenges are intended for individuals 18 years of age or older. You must be at least 18 years old to register for or purchase participation in a Run Motivators event or challenge.

Run Motivators does not accept registrations from minors and does not undertake responsibility for supervising or determining the suitability of an event or challenge for anyone under the age of 18.

If an adult purchaser chooses to allow a minor to use, participate in, or receive an event registration, challenge, or associated reward purchased by the adult, that decision is made independently by the adult and is solely the adult's responsibility. Run Motivators does not supervise or assume responsibility for such participation.

9. Electronic Acceptance

By checking a box indicating acceptance of these Terms, completing a purchase or registration after being presented with these Terms, or otherwise electronically indicating your agreement, you acknowledge that you have read, understand, and agree to these Terms.

Your electronic acceptance is intended to have the same effect as written acceptance to the extent permitted by applicable law.

10. Event Changes

Run Motivators may modify an event or challenge when reasonably necessary.

Changes may include event dates, suggested completion periods, mileage or activity instructions, reward shipping schedules, product details, or other event features.

Because Run Motivators events are virtual, participants generally have flexibility regarding when and where activities are completed unless the individual event rules specifically state otherwise.

If Run Motivators cancels an event or product and is unable to provide purchased merchandise or another appropriate resolution, affected purchases will be handled in accordance with our Refund, Return, Cancellation & Shipping Policy.

11. Event Registrations & Rewards

Many Run Motivators virtual events include or offer physical merchandise such as medals, challenge coins, charms, stickers, apparel, or other rewards.

Purchasing the applicable event registration or reward constitutes registration for the virtual event or challenge unless otherwise stated in the product description.

Unless specifically stated otherwise, you are not required to submit proof of completion before receiving purchased event merchandise.

Receiving an event reward does not constitute certification or verification by Run Motivators that a participant completed a particular distance, activity, or challenge.

Event registrations and rewards that have already been processed for shipment are subject to the applicable final-sale provisions of our Refund, Return, Cancellation & Shipping Policy.

12. Promotions, Discounts, Free Gifts & Cart Rewards

Run Motivators may offer discounts, promotional codes, free gifts, cart rewards, free shipping, or other promotional offers.

Unless otherwise specifically stated:

• Promotional offers have no cash value.

• Promotions may not be combined with other offers.

• Promotional thresholds are calculated based on the qualifying merchandise subtotal after applicable discounts and before taxes and shipping.

• Free gifts and promotional merchandise are available only while supplies last.

• Promotional offers may be modified or discontinued as permitted by applicable law.

• Discounts and promotional offers cannot be applied retroactively to previously completed purchases.

If merchandise is returned and the return causes the original order to fall below the qualifying threshold for a free gift or other promotional benefit, the promotional item may also be required to be returned unused and in its original condition.

If a promotional item that must be returned is not returned, its stated retail value may be deducted from an otherwise applicable refund to the extent permitted by law.

13. Gift Cards & Store Credit

Gift cards and store credits have no cash value and are not redeemable for cash except where required by applicable law.

Gift cards and store credits may be subject to additional terms disclosed at the time they are issued or purchased.

14. Accounts & Results Reporting

Certain Run Motivators services may allow participants to create accounts, record results, track activities, maintain mileage or other records, or access event information.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree not to knowingly submit fraudulent results, interfere with another participant's account, attempt to gain unauthorized access to our systems, manipulate results or records, or use our website or results platform in a manner intended to disrupt its operation.

Run Motivators reserves the right to correct or remove fraudulent, abusive, erroneous, or inappropriate submissions.

While we make reasonable efforts to maintain our website and results services, we do not guarantee uninterrupted access or permanent storage of participant-submitted data. Participants are responsible for maintaining their own records of activity or results they consider important.

15. Acceptable Use of the Website

You may not use the Run Motivators website or services to:

• Engage in fraudulent or unlawful activity;

• Attempt to gain unauthorized access to accounts, systems, or data;

• Introduce viruses, malicious code, or other harmful technology;

• Scrape, copy, reproduce, or commercially exploit website content without authorization;

• Interfere with the operation or security of the website;

• Impersonate another person or intentionally provide false information;

• Abuse discounts, promotions, free gifts, payment systems, returns, refunds, or other website features; or

• Use Run Motivators intellectual property without authorization.

We reserve the right to restrict access, suspend accounts, refuse service, or cancel orders associated with fraudulent, abusive, or unlawful activity to the extent permitted by law.

16. Intellectual Property

Unless otherwise stated, content created or owned by Run Motivators, including its logos, branding, original event names and concepts, artwork, medal and merchandise designs, graphics, photographs, written content, and other original materials, is owned by or licensed to Run Motivators LLC and is protected by applicable intellectual property laws.

Purchasing a product does not transfer ownership of the underlying artwork, design, trademark, copyright, or other intellectual property.

Run Motivators content may not be reproduced, copied, modified, manufactured, distributed, sold, or commercially exploited without authorization from Run Motivators or the applicable rights holder.

17. Third-Party Services

Our website and services may use, integrate with, or link to third-party services, including payment processors, shipping carriers, ecommerce platforms, results platforms, social media services, and other providers.

Run Motivators is not responsible for the independent operation, availability, policies, content, security, or practices of third-party websites or services.

Your use of third-party services may also be subject to the terms and policies of those providers.

18. Website Availability

We make reasonable efforts to maintain access to our website and online services but do not guarantee that they will always be available, uninterrupted, secure, or error-free.

We may temporarily suspend or restrict portions of the website for maintenance, upgrades, security, technical problems, or other operational reasons.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Run Motivators LLC and its owners, officers, employees, agents, representatives, contractors, volunteers, sponsors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the website, purchase of products, use of our online services, or participation in a Run Motivators activity.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Run Motivators LLC and its owners, officers, employees, agents, representatives, contractors, volunteers, sponsors, and affiliates from third-party claims, damages, losses, liabilities, or reasonable expenses arising from your unlawful misuse of our website or services, violation of these Terms, or infringement of another person's rights.

21. Privacy

Information collected through the Run Motivators website is handled in accordance with our Privacy Policy.

By using the website, you acknowledge that you have had the opportunity to review our Privacy Policy.

22. SMS/MMS Mobile Messaging Program

Run Motivators may offer an optional SMS/MMS mobile messaging program (the "Program") through which customers and subscribers may receive updates, alerts, information, promotions, special offers, and other marketing communications.

Consent to receive marketing text messages is not required as a condition of purchasing any goods or services from Run Motivators.

By voluntarily opting into the Program, you consent to receive SMS and/or MMS messages from Run Motivators at the mobile number you provide. Messages may be sent using automated technology. Message frequency varies. Message and data rates may apply depending on your wireless plan.

You are responsible for providing a valid mobile number and for any charges imposed by your wireless carrier.

Opting Out

You may cancel your participation in the Program at any time by replying STOP to a Run Motivators marketing message.

You may receive a final message confirming your opt-out request.

For assistance, reply HELP to the number from which you received the message or contact Run Motivators.

If you change or discontinue the mobile number used to subscribe to the Program, you should opt out before discontinuing use of that number.

Wireless carriers are not responsible for delayed or undelivered messages.

Run Motivators may modify, suspend, or discontinue its mobile messaging program or change the telephone number used to send messages.

Participation in the Program is subject to applicable law and any additional disclosures presented when you opt in.

23. Changes to These Terms

Run Motivators may update these Terms periodically to reflect changes to our services, business practices, policies, or applicable requirements.

The current version will be posted on our website with an updated "Last Updated" date.

Changes will apply prospectively unless otherwise required by law. Purchases already completed remain subject to the material purchase terms and policies applicable to the transaction when the order was placed, except where a change is required by law.

24. Governing Law

These Terms and disputes arising from them will be governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in these Terms deprives a consumer of protections or rights that cannot lawfully be waived.

25. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will continue in effect.

26. No Waiver

Run Motivators' failure to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision or another provision in the future.

27. Entire Agreement

These Terms, together with our Refund, Return, Cancellation & Shipping Policy, Privacy Policy, and other policies expressly incorporated by reference, constitute the agreement between you and Run Motivators regarding your use of the website, purchases, and participation in Run Motivators virtual events and challenges.
